1. Overview
Lace Fox Media ("we," "us," or "the Company") respects the intellectual property rights of others and expects the creators and collaborators who provide content to us to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to valid claims of copyright infringement reported to our designated agent at info@lacefoxmedia.com. This policy outlines the procedures for reporting claimed copyright infringement, filing counter-notifications, and our approach to repeat infringing creators or collaborators.
2. Notice of Infringement — Takedown Procedure
If you believe that content produced or distributed by Lace Fox Media in collaboration with a creator or collaborator infringes upon your copyright, you may submit a written notification to our designated DMCA agent at info@lacefoxmedia.com containing the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner;
- Identification of the copyrighted work(s) claimed to have been infringed, or, if multiple works at a single location are covered, a representative list of such works;
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to enable us to locate the material (e.g., direct URL);
- Your contact information, including name, mailing address, telephone number, and email address;
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Please submit all DMCA takedown notices to our designated agent at: info@lacefoxmedia.com
Upon receipt of a valid takedown notice, Lace Fox Media will act expeditiously to remove or disable access to the allegedly infringing material. We will make reasonable efforts to notify the creator or collaborator who provided the content that it has been removed.
3. Counter-Notification Procedure
If you are a creator or collaborator who provided material to Lace Fox Media and believe that the material was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our designated DMCA agent at info@lacefoxmedia.com containing the following:
- Your physical or electronic signature;
- Identification of the material that was removed or to which access was disabled, along with the location at which the material appeared before it was removed or disabled;
- A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, mailing address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Lace Fox Media may be found), and that you will accept service of process from the party who filed the original takedown notice or an agent of such party.
Upon receipt of a valid counter-notification, Lace Fox Media will forward a copy to the party who submitted the original takedown notice. If the original complainant does not file a court action seeking a restraining order within ten (10) business days, we may restore the removed material in accordance with DMCA procedures.
4. Repeat Infringer Policy
In accordance with the DMCA and our internal policies, Lace Fox Media maintains a strict repeat infringer policy for creators and collaborators. We will, in appropriate circumstances and at our sole discretion:
- Suspend and/or terminate collaboration with creators or collaborators found to be repeat copyright infringers;
- Remove content provided through a terminated collaboration;
- Decline future collaboration with the repeat infringing creator or collaborator.
A "repeat infringer" is any creator or collaborator from whom Lace Fox Media has received more than two (2) valid DMCA takedown notices for which that creator or collaborator did not successfully file a counter-notification. We may also consider patterns of behavior, the severity of the infringement, and good faith when making termination decisions.
5. Misrepresentation Warning
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorney fees, incurred by the alleged infringer, the copyright owner, or the service provider. We strongly encourage you to consult with a legal professional before filing a DMCA takedown notice or counter-notification.
6. Limitation of Liability
Lace Fox Media produces and distributes content in collaboration with its contracted creators, and responds to valid takedown notices concerning that content in accordance with this policy.
